APPROVED MINUTES
Regular Meeting
March 26, 2008, 7:30 p.m.
31 Pecks Lane, Newtown, Connecticut

Present:  Peters, Salling, Pieragostini, Curran, Gillingham and Clancy
Staff Present:  Robert Sibley, Deputy Director; Tammy Hazen, Clerk

Commissioner Peters opened the hearing at 7:30 p.m.

Violations

Ann Astarita, Newtown Inland Wetlands Enforcement Officer, was present to discuss Inland Wetlands Violation #08-22, 166 & 176 Mt. Pleasant Road.  The violation includes discharge of sewage and other materials in wetlands and a watercourse.  The violation will be kept active until there is a resolution.  Commissioner Pieragostini motioned to uphold the findings of the Inland Wetlands Enforcement Officer.  Seconded by Commissioner Curran.  Motion carried unanimously.

Pending Applications

#08-06   North Point Construction, LLC, 38 Taunton Hill Road. Application for activities within a regulated area and the removal of a violation.

Item tabled.

#08-07   William F. Renz, 48 The Old Road.  Application for activities within a regulated area and the removal of a violation.

Commissioner motioned to approve application with standard conditions A, B, C, and:
1.      The approved plans for the development are:  Site Plan Dated March 26, 2008 and supporting materials.
2.      The applicant will install a split rail fence or suitable replacement along the edge of the proposed lawn limit in the rear yard.  To be inspected and approved by the Wetlands Agent.
3.      The applicant will complete the required conditions stated on the approved plans within six months of this approval.  To be inspected and approved by the Wetlands Agent.

#08-08   St. Rose/Knights of Columbus, 46 Church Hill Road.  Application for activities relating to the construction of a building.

Commissioner Clancy motioned to approve application with standard conditions A, B, C, D, E, and:
1.      The approved plans for the development are:  Site Plan “Proposed Site Plan, 46 Church Hill Road, Newtown CT, proposed Knights of Columbus Building, Dated Revised March 26, 2008 and supporting materials.

#08-09   Vona, Oak Ridge III, 46 Eden Hill Road.  Application for activities relating to a subdivision.

Public Hearing has been set for April 23, 2008.

#08-10    Gary Gaydosh, 902 Huntingtown Road. Application for activities within a regulated area and the removal of a violation.

Alan Shepherd, Professional Engineer, Shelton, CT, presented plans for restoration of a disturbed area at Mr. Gaydosh’s riding facility.  Mr. Shepherd will work with staff to resolve this issue.  Mr. Sibley stated that the plans address all the Conservation Commission’s concerns.  The commissioners will visit the site.

IW Ext #03-26   Ferris, 143 South Main Street.  Commissioner Salling motioned to approve with standard conditions A, B, C, and

1.      The approved expiration date for this permit is August 27, 2013.

Public Hearing

#08-04   Hattertown LLC, 22 Hattertown Road.  Application for activities within a regulated area.

This item was tabled.

Other Business

Minutes – March 12, 2008 – Commission Pieragostini motioned to approve the minutes.  Seconded by Commissioner Salling.  Commissioner Curran abstained.  Motion carried unanimously.

Acceptance of New Applications

No new applications.

Commissioner Pieragostini motioned to adjourn the meeting at 8:35 p.m.  Seconded by Commissioner Salling.  Motion carried unanimously.
